Do I have to disclose problems with my house when I sell in Massachusetts?

Massachusetts is a caveat emptor state, but sellers still have specific duties: you must not misrepresent or conceal known defects, and certain disclosures are mandatory, including lead paint on pre-1978 homes and the septic system under Title 5.

  • What must a Massachusetts seller tell the buyer?

The Seller's Statement of Property Condition, the form many buyers request, is not required by Massachusetts law, but it is widely used and many brokerages require it, and if you fill one out, every answer must be truthful.

Mandatory items are the ones to have nailed down: any pre-1978 home carries a lead paint disclosure obligation, and septic-serviced properties require the Title 5 inspection and disclosure. Smoke and carbon monoxide detector certificates are also part of a compliant closing.

The safest approach is straightforward: answer every question honestly and let your attorney and agent guide the paperwork. Honest sellers have little to fear from disclosure, and quiet problems are the ones that come back to bite.

Your agent's job is to help you understand exactly what to say and what to keep, so nothing slips through out of confusion rather than intent.

On the North Shore

North Shore housing stock runs old, which means lead paint disclosures are common, and the unsewered coastal towns mean Title 5 is a familiar part of the file. I handle these every week and make them routine rather than frightening.

This is general information about Massachusetts seller disclosure, not legal advice. Disclosure obligations are specific to each property and transaction, so review yours with your attorney.
