Selling & Buying at the Same Time · Straight answer from Kathleen
Can I stay in my house after I sell it?
Yes. A rent-back, sometimes called a use-and-occupancy agreement, lets you sell your home and then rent it from the new owners for an agreed period, typically a few weeks to a couple of months.

- What is a rent-back or use-and-occupancy agreement?
It is a common and clean way to sell first without moving twice. The buyer gets a sold home, and you get time to close on the next one, pack at a human pace, or finish the school year.
The agreement spells out the rent, the move-out date, utilities, and how any damage is handled. Your attorney protects your interests in the details; the new owners' attorney protects theirs.
Rent-backs are very negotiable and very normal. I would guess a good share of the North Shore sales I see include one at some point in the year.
On the North Shore
In the coastal towns, rent-backs are especially useful in spring and summer, when buyers want to close on a beach home they will not occupy until later, and sellers want time before their next move.
